Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Rainmaker TikTok Intelligence platform at tt.rainmakeragency.ai (the “Service”), operated by Rainmaker Network LTD, a company registered in the Republic of Cyprus under registration number HE 415834 (“Rainmaker”, “we”, “our” or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

The Service is a business analytics tool that presents TikTok trend and advertising data — including hashtags, sounds, search demand, videos and competitor profiles — to authorised users, using data provided through the official TikTok Business API. The Service is intended for professional, internal marketing use.

2. Eligibility and accounts

Access to the Service is provided to authorised users on an account basis. You must be at least 18 years old and authorised to act on behalf of the organisation you represent. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

3. Acceptable use

You agree not to:

  • Use the Service in violation of any applicable law or third-party rights;
  • Attempt to gain unauthorised access to the Service, its systems or other users’ data;
  • Interfere with, disrupt or overload the Service or its infrastructure;
  • Reverse engineer, scrape or extract data from the Service other than through provided functionality;
  • Use the Service or any TikTok data in a way that violates the TikTok Developer Terms or TikTok policies.

4. TikTok data and third-party terms

The Service relies on the TikTok Business API. Your use of TikTok data through the Service is additionally subject to TikTok’s applicable terms and policies. Rainmaker is not affiliated with, endorsed by, or sponsored by TikTok. TikTok is a trademark of its respective owner. We are not responsible for changes to, or the availability of, the TikTok API or the accuracy of data supplied by TikTok.

5. Intellectual property

The Service, including its software, design, text and graphics (excluding third-party data), is owned by or licensed to Rainmaker and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes. All rights not expressly granted are reserved.

6. Disclaimer of warranties

The Service and all data are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that data displayed will be accurate or complete.

7. Limitation of liability

To the maximum extent permitted by law, Rainmaker shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or business, arising out of or in connection with your use of, or inability to use, the Service, even if advised of the possibility of such damages.

8. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.

9. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes to these Terms will be indicated by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Cyprus.
